Article 8 of the Saudi Labor Law establishes an absolute legal safeguard against the forfeiture of statutory labor rights. It dictates that any condition or agreement attempting to waive the End of Service Benefit (EOSB) is legally null and void, protecting workers from forced financial settlements.

The Legal Framework of Nullifying Waivers (Article 8)

The Saudi Labor Law explicitly invalidates any contract clause or external agreement that contradicts statutory worker protections. Under Article 8, any release or settlement of the worker’s rights arising from the law during the validity of the Employment Contract is deemed entirely void. This means employers cannot legally enforce a waiver that forces a worker to surrender their financial dues.

Final Clearance (Makhlasa) and Forced Waivers

Employers frequently attempt to force exiting employees to sign a Final Clearance (Makhlasa), falsely stating that the worker has received all financial dues before handing over a passport or exit visa. Because Article 8 protects the End of Service Benefit (EOSB) as a first-rate privileged debt, signing a waiver under pressure does not eliminate the worker’s right to claim their unpaid funds.

The Exception: When is a Settlement Valid?

The law provides one strict exception to the invalidity of waivers. A settlement or release of rights under Article 8 is only recognized as legally valid if the new condition is definitively more beneficial to the worker. If the waiver diminishes the baseline statutory payout, it holds zero legal weight in the Saudi Labor Courts.
